Article 1: Purpose
These General Terms and Conditions of Sale determine the rights and obligations of the parties in the context of online sales of Products offered by the Seller.
Article 2: General Provisions
These General Terms and Conditions of Sale (T) apply to all sales of Products, made through the Animale Thérapie website, which are an integral part of the Contract between the Buyer and the Seller.
The Seller reserves the right to modify these at any time by publishing a new version on its website. The applicable TCs are those in force on the date of payment (or the first payment in case of multiple payments) of the order. Animale Thérapie also ensures that their acceptance is clear and without reservation by implementing a checkbox and a validation click.
The Customer declares to have read all of these General Terms and Conditions of Sale, and if applicable, the Specific Terms and Conditions of Sale related to a product or service, and to accept them without restriction or reservation.
The Customer acknowledges having received the necessary advice and information to ensure that the offer meets their needs.
The Customer declares to be legally able to contract under French law or validly represent the natural or legal person for whom they are committing.
Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.
Article 3: Price
The prices of products sold through the website are indicated in Euros including VAT and are precisely determined on the product description pages. They are also indicated in euros including all taxes (VAT + other possible taxes) on the product order page, and excluding specific shipping costs.
Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These duties and sums are not the responsibility of the Seller. They will be borne by the buyer and are their responsibility (declarations, payment to competent authorities, etc.).

Article 4: Conclusion of the Online Contract
The Customer must follow a series of steps specific to each Product offered by the Seller to place an order. However, the steps described below are systematic:

– Choice of Product, its options if applicable, and indication of essential Customer data (identification, address, etc.);
– Acceptance of these General Terms and Conditions of Sale.
– Verification of order details and, if applicable, correction of errors.
– Following payment instructions, and payment for the products.
– Delivery of the products.
The Customer will then receive confirmation by email of the order payment, as well as an acknowledgment of receipt confirming the order.
For delivered products, this delivery will be made to the address indicated by the Customer.
For the proper fulfillment of the order, and in accordance with Article 1316-1 of the Civil Code, the Customer agrees to provide accurate identification information.
The Seller reserves the right to refuse the order, for example for any abnormal request, made in bad faith or for any legitimate reason.
Article 5: Products and Services
The essential characteristics of the goods, services, and their respective prices are made available to the buyer on the Animale Thérapie website.
The customer acknowledges having received details of delivery charges as well as payment terms, delivery, and contract execution methods.
The Seller commits to fulfilling the Customer’s order only within the limits of available Product stock. Otherwise, the Seller will inform the Customer.
This contractual information is presented in detail and in French. In accordance with French law, they are subject to a summary and confirmation during order validation.
The parties agree that the illustrations or photos of products offered for sale have no contractual value.
The validity period of the Product offer as well as their prices are specified on the Company’s website, along with the minimum duration of proposed contracts when these involve continuous or periodic supply of products or services.
Unless otherwise specified, the rights granted under these terms are only to the individual signing the order (or the person holding the provided email address).

Article 6: Retention of Title Clause
The products remain the property of Animale Thérapie until full payment of the price.
Article 7: Delivery Methods
Ordered products are delivered according to the following methods:
-Mondial Relay
Delivery is made within 4 days to the chosen relay point.
-Colissimo without signature
Delivery is made within 2 days to your home from Monday to Saturday, except public holidays.
-Chronopost Express
Delivery is made within 24 hours to your home from Monday to Saturday, except public holidays.
The Seller cannot be held responsible for loss or delivery delays due to errors or disruptions attributable to carriers.
The carrier delivery times mentioned above are only indicative.
Products are delivered to the address indicated by the buyer on the order form; the buyer must ensure its accuracy.
Any package returned to the seller due to an incorrect or incomplete delivery address will be reshipped at the buyer’s expense.
If at the time of delivery, the original packaging is damaged, torn, or opened, the buyer must then check the condition of the items. If they have been damaged, the buyer must immediately contact the delivery company.
If the products need to be returned to the seller, they must be subject to a return request to the seller within 14 days following delivery. Any claim made outside this period cannot be accepted. The return of the product can only be accepted for products in their original condition (packaging, accessories…).
Article 8: Availability and Presentation
Orders will be processed within the limits of our available stock or subject to stock availability from our suppliers.
In case of unavailability of an item for a period exceeding 15 working days, you will be immediately informed of the expected delivery times and the order for this item can be cancelled upon simple request. The Customer can then request a credit note for the amount of the item or a refund.
Production times for items vary depending on the time of year.
Article 9: Payment
This is an order with payment obligation, which means that placing the order implies payment by the buyer.
To pay for their order, the buyer has, at their choice, all the payment methods made available by the seller and listed on the seller’s website.
The buyer guarantees to the seller that they have any necessary authorizations to use the payment method chosen by them when validating the order form.
The seller reserves the right to suspend any order processing and delivery in case of refusal of payment authorization by credit card from officially accredited organizations or in case of non-payment.
The seller reserves the right to refuse to make a delivery or to honor an order from a buyer who has not fully or partially paid for a previous order or with whom a payment dispute is currently being processed.
The seller has implemented an order verification procedure to ensure that no one uses another person’s banking details without their knowledge. As part of this verification, the buyer may be asked to email the seller a copy of an identity document and proof of address. The order will then only be validated after receipt and verification of the sent documents by the seller.
Payment of the price is made in full at the time of order, by credit card (Carte Bleue, Visa, Eurocard, Mastercard), it being specified that payments are secured by the universal SSL encryption process, associated with the PAYPAL or Stripe payment solution.
In this case, the buyer must provide their credit card number on the Site, as well as its expiration date and the cryptogram number (3-digit number on the back of the credit card), it being specified that the credit card data is only kept during the order processing time (secure communication protocol).
The card will be debited at the time of the order.
The online provision of the credit card number and the final validation of the order will serve as proof of the entirety of said order.
Article 10: Withdrawal Period and Returns
It is previously specified that this right of withdrawal is excluded for contracts of goods made to the buyer’s request or clearly personalized.
In accordance with the provisions of the Consumer Code, the buyer has a period of 14 working days from the delivery date of their order to return any item that does not suit them and request an exchange or refund without penalty. Returns are exclusively made by Colissimo and are at the client’s expense.
However, products must be returned in their original packaging and in perfect condition within 14 days following the notification to the seller of the buyer’s decision to withdraw.
Returns must be made in their original condition and complete (packaging, accessories…) allowing their resale as new, accompanied by the purchase invoice.
Damaged, soiled or incomplete products are not accepted.

Article 11: Warranties
In accordance with the law, the Seller assumes two warranties: conformity and relating to hidden defects of the products.
The Seller refunds the buyer or exchanges products that are apparently defective or do not correspond to the order placed.
The Seller reminds that the consumer:
– has a period of 2 years from the delivery of the goods to take action against the Seller
– can choose between replacement or repair of the goods subject to the conditions provided by the aforementioned provisions. apparently defective or not corresponding
– is exempted from providing proof of the existence of the lack of conformity of the goods during the six months following the delivery of the goods.

All texts, comments, photographs, illustrations and images, catalogs whether visual or audio, reproduced on the site www.animaletherapie.com are protected under copyright law, trademark law and image rights. They are the exclusive property of Animale Thérapie.
Any other use constitutes infringement and is sanctioned under Intellectual Property law.
Article 13: Force Majeure
The execution of the seller’s obligations under these terms is suspended in the event of a fortuitous event or force majeure that would prevent their execution.

Article 14: Nullity and Modification of the Contract
If one of the provisions of this contract were to be annulled, this nullity would not result in the nullity of the other provisions which will remain in force between the parties. Any contractual modification is only valid after a written agreement signed by the parties.
